You are renting our ballroom for a private event/party.
This Facility Event Space Rental Agreement is made and entered into agreement between Destination Wellness ("Owner"), located at 31 W Church St. Newark OH 43055, and the above named "Renter".
The Renter desires to temporarily rent, occupy, and make use of the Owner’s venue, located at 31 W Church St., Newark, OH and known as Destination Wellness.
The Owner agrees to such rental, occupation, and use in consideration of certain payments and covenants herein enumerated.
Now, therefore, the parties agree to the following terms and conditions:
EVENT DESCRIPTION / VENUE ACCESS
The Renter shall have access to and use of the venue for the purpose of hosting the Renter’s event. Owner will provide to Renter door access codes, and other items necessary to give Renter such access.*
RENTAL COST
The full rental fee for the use of the venue shall be $299 + $100 Deposit/Cleaning Fee. The balance of the rental fee due, shall be payable to the Owner 24 hours prior to the start of the rental period described above.*
DEPOSIT / CLEANING FEE
The Renter shall pay to the Owner the sum of $100, no later than 24 hours prior to the start of Renter's event, for cleaning fees and/or property damage. The fee is for damages/security deposit which will be returned to the Renter upon settlement, minus any charges for actual damages done to the venue by the Renter or his/her associates. Or, minus any charges for clean up not completed by Renter prior to leaving property. *
TO RECEIVE FULL CLEANING DEPOSIT, RENTER AGREES TO:
Renter shall remove all personal property, trash, and other items that were not present in the venue when Renter took control of it.*
Renter shall empty trash receptacles used and place tied trash bags in Kitchen space. Renter shall refill trash receptacles with clean bags. *
Renter shall remove all decorations (including tape) and leftover food.*
Renter shall remove all food and food scraps used for prep from kitchen sinks. Renter shall clean and return any dishes used in prep (if DW owned). Renter shall remove/discard dishes that are Renter owned. Sinks are to be free of food, debris, and dishes.*
Renter shall leave floors dry and free of debris (food or decoration). If drinks have been spilled, it is the Renter's responsibility to mop the floors. Mopping supplies are included in kitchen space. *
Renter shall place DW owned tablecloths in the laundry bin in the locker/sauna room, to be laundered by DW Staff. *
Renter shall return tables and chairs to their original location unless otherwise agreed upon. *
RETURN OF DEPOSIT / CLEANING FEE
Upon Renter’s completion of his/her obligations above, the Owner shall return to Renter the security deposit minus any amounts deemed necessary to repair damages inflicted upon the venue by Renter and/or Renter’s associates, guests, invitees, contractors, and all other persons whatsoever who enter the venue during the rental period, whether or not such persons did so with Renter’s knowledge or consent.*
LIABILITY
Renter will be liable for any physical damages, legal actions, and/or loss of reputation or business opportunities that Owner may incur as a consequence of the actions of Renter or any of Renter’s guests while Renter is in control of the venue, and shall indemnify and hold harmless the Owner against any and all legal actions which may arise from Renter’s use of the venue.*
DISPUTES
Any disputes arising under this contract shall be adjudicated in the Owner’s local jurisdiction.
In witness of their understanding of and agreement to the terms and conditions herein contained, the Renter affixes signature below.
